Legal question about potential fire?
My husband needed a replacement battery for his cell phone because it wouldn’t hold a charge. The company sent him a new battery. He took the ancient battery and placed it in a plastic bag provided by the cell phone company. The bag was then tossed on the bed in our spare bedroom. Somehow the battery burned through the bag, a 3.5 inch tempurpedic mattress pad, all of my bedding, and a practically new mattress. My entire house may maybe have gone on fire as this happened while we were away on vacation. I called the cell phone company. They basically told me that I was lying since nothing like this has ever happened before, but offered to give me one month of free service. Well, that’s nice, but all of my bedding, my mattress pad and my bed are ruined and my house may maybe have gone on fire. I would like for the cell phone company to replace everything. Is this something that I should consider hiring an attorney for, or would it be more of a head ache then it is worth?

This is bizarre. But, Dell and additional computer makers had recalls on their mainframe batteries due to fire hazards, so I imagine it might be possible. I would suggest filing an insurance aver through your insurance company for the fire.
More than likely, the insurance company will want to conduct an investigation and will look seriously at the battery. If it is the battery the insurance company will pursue the makers of the battery.

If you have some kind of proof, and photos, you might want to take them to court. It would have to be small claims, as I am guessing that your hurts were worth less than $ 5,000.00. But, at least in the state of California you are not allowed an attorney in small claims court, and for that amount of money, it would be hard to find an attorney that would take it anyway. But, them life a company, would have a representative in court that would know their way around a judge. You should at least get a legal consultation, there may be another way around it.

From a lawyer. A lawyer will not handle a case this small. But, you can file a lawsuit in small claims court in JP court. It’s cheap, simple and quick. It works just like the judge shows on TV. These shows usually come on during the day some record one or two and see how it looks.

Such things happen here once in a while due to an overcharged or shorted battery.
We place ancient batteries outside and dispose of them as quickly as possible.

I use two towels each time I shower because my hair is thick and holds so much water it drips for HOURS so I have one on my head and one wrapped around me xD plus i’ll be all boiling and nasty and I just really dont want to reuse them after all that nasty-ness of sweat and chlorine xD
