How do people sell unlocked NEW cell phones on eBay?

Where are public getting the phones from that are new unlocked, primarily GSM phones and how does one access that supply?

Is there any huge difference between a cell phone and a RIM cell phone? How come a rim cell phone seems to be cheaper?
