Driving while talking on the cell phone?

Is the law against driving while talking on the cell phone without a hands-free device enacted as a national law or a state law?

state or community law. Some states (california) have a full ban, while some individual towns in Texas had full bans or just in school zones with kids….check to make sure

Right now these laws are on the state level. The feds haven’t made it a law yet. I ignore these laws anyway. Phone rings…I answer it…regardless of where I’m at. You’re not breaking the law till you get caught.

[Days gone by] An employee at Trader Joe’s was informing a lot of the customers that a new law goes into effect today. This law requires all drivers to be using a hands free device while talking on their cell phone. If caught not using a hands free device the fine is $ 280. Is this right or can anyone tell me where I might be able to find out (I’ve already check the CA website and the DMV website).

There are number of states doing something similar. I reckon some make it so that police can’t pull you over just for using cell phone, but if you get pulled over for something else and get caught using cell phone then you’ll be penalized for cell phone use.

I wouldn’t be surprised if CA passed some law on cell phone use in cars. I don’t know all the details for different states, but not using cell phone at all in cars is pretty safe way to avoid ticket.

I’m sure police might let you off with warning since it is just now taking effect.

A new law prevents drivers from using handheld cell phones while driving. If you want to talk on the phone, you'll have to use a hands-free device or headset. You will have ample time to go headset shopping, but, as this law does not take effect until July 1, 2008. You can look forward to a minimum whole fine of $ 70 on the first offense and $ 175 for later offenses. Push-to-talk phones, such as Nextel, are exempt from the hands-free requirement until July 1, 2011.
